Ezra Miller Gets One Year Probation From May Burglary Incident

Ezra Miller as The Flash in Justice League gets one year probation
Warner Bros.

Ezra Miller entered a plea deal following a May incident in which they were charged with trespassing, petit larceny (breaking and entering), and burglary.  Miller was caught on security footage breaking into a neighbor’s home near their Vermont home and stealing bottles of alcohol.  Miller initially pled not guilty to all charges. With this deal, they pled guilty to the misdemeanor charge of trespassing in exchange for the court dropping the more serious charges.

Miller had to pay a $500 fine (which should mean nothing to them) and will be on probation for one year.

Superior Court Judge Kerry A. McDonald-Cady accepted Miller’s plea, stating:

“The court will impose the sentence here….we accepted your plea of guilty. We will impose the fine here $500, and the sentence of 80-90 days which is all suspended with probation. The term of probation will be one year.”

“As part of the plea agreement here, the state will dismiss without prejudice counts 1 and 2, of the burglary and petit larceny.

“You’ll be on administrative probation for one year for the unlawful trespass that you’ll be pleading guilty to. If you complete that probation successfully and the probation is closed and discharged, count 1 will remain dismissed.  However, if there’s a violation of probation that was filed that a court found probable cause for, the state could refile the count 1 burglary.”

As you can see, Miller has to stay out of trouble for one year. This may be difficult considering the actor’s past.  Not being a legal expert, I’m not sure if drug testing is part of the probation process.  It has been clear for some time now that in addition to mental health issues, Miller has struggled with drug and alcohol abuse.

Following their appearance in court, Miller’s attorney, Lisa B. Shelkrot of the law firm Langrock, Sperry & Wool, issued a statement, saying:

“Ezra Miller pled guilty this morning to a misdemeanor unlawful trespass in Vermont Superior Court and accepted the conditions imposed by the court. Ezra would like to thank the court and the community for their trust and patience throughout this process, and would once again like to acknowledge the love and support they have received from their family and friends, who continue to be a vital presence in their ongoing mental health.”

This situation solely revolves around this one instance.  Miller has been plagued by accusations of assault, essentially forming a cult, and of grooming underage girls.

The Future Of the DCEU

Despite all of this, Warner Bros. has remained steadfast in its intention of releasing the actor’s star vehicle The Flash, an installment of its current DCEU franchise. It appears the Fantastic Beasts brand, in which Miller also starred, may be on the rocks and may not move forward.  The Flash, which was directed by Andy Muschietti, has been sitting on the shelf for a while.  That seems to have more to do with the tumult behind the scenes at WB, although Miller’s problems certainly didn’t help.

Insiders have stated that The Flash is a really good movie that WB wants to succeed. This is why they haven’t scrapped the film altogether and chalked it up to a tax write-down, the way they did with the not-yet-complete Batgirl movie.

In August, Miller issued a public statement apologizing for their behavior and entered mental health therapy.  They have also been accompanied by their mother in most public appearances.

While WB is intent on releasing The Flash, it seems almost impossible that Miller will return as the titular character. It has already been announced that Henry Cavill will not be back as Superman, and Ben Affleck already departed the role of Batman.  Wonder Woman 3 has been scrapped, so it isn’t likely that Gal Gadot will be back as Wonder Woman.  Most are speculating (and it’s just SPECULATION) that James Gunn and Peter Safran are rebooting the entire DC franchise from the bottom up.

Let’s just hope that this is the last time we hear anything more about Ezra Miller and the law.  At this point, The Flash is set to hit theaters on June 16, 2023.
